Terms of Use for Surveris

Welcome to Surveris (“the App”, “we”, “us”, or “our”). By downloading, accessing, or using Surveris, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the App.

1. Service Description

Surveris is a mobile/web application that allows users to take photos of tiles and receive suggestions or matches from our backend tile database. Uploaded images are processed securely in the cloud to compare visual features such as texture, pattern, and color.

2. Eligibility

By using Surveris, you represent and warrant that:

You are at least 13 years old.
You have the legal capacity to agree to these terms.
All information you provide is accurate and truthful.

3. Acceptable Use

You agree to use Surveris only for lawful purposes and in accordance with these terms. You agree not to:

Upload illegal, defamatory, offensive, or infringing content.
Reverse engineer, modify, or tamper with the App or its components.
Attempt to collect personal data from other users.
Disrupt the integrity or performance of the App or any connected services.

4. Accounts and Security

If authentication is required:

You are responsible for maintaining the confidentiality of your login credentials.
You agree to notify us immediately of any unauthorized access or breach.
You are responsible for all activities under your account.

5. Intellectual Property

a. User-Uploaded Content

You retain ownership of images you upload to the App.
By uploading, you grant Surveris a limited, revocable, non-exclusive license to store, process, and analyze your content for the purpose of providing the tile identification service.
With your explicit consent, we may use anonymized data to improve our algorithms.

b. App Content and Branding

All rights, title, and interest in and to the App, its code, design, graphics, logos, and brand elements are owned by Surveris or its licensors.
No license or right is granted except for your limited use of the App under these terms.

6. Data Storage and Processing

Surveris stores and processes images and metadata using Google Cloud Platform (GCP) infrastructure, with encryption at rest and in transit. See our Privacy Policy for details about data use, retention, and protection.

7. Fees and Payment

Surveris may provide both free and paid features. If fees apply:

They will be clearly disclosed before any charge.
Payments are processed via secure third-party platforms.
Surveris does not store or process payment card information directly.

8. Termination

You may stop using the App at any time. We reserve the right to suspend or terminate access if:

You violate these Terms.
Your activity is malicious, illegal, or poses risk to others.
We are required to by law or regulation.

9. Limitation of Liability

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not guarantee:

Tile match accuracy.
That the App will be uninterrupted, error-free, or secure.

Surveris will not be liable for:

Any indirect, incidental, or consequential damages.
Data loss, service interruptions, or loss of revenue.

10. Indemnification

You agree to defend, indemnify, and hold harmless Surveris, its affiliates, and personnel from any claim, liability, or expense arising from:

Your use of the App.
Your violation of these Terms.
Your infringement of any rights of another.

11. Changes to These Terms

We may update these Terms from time to time. You will be notified of changes via the App or our website. Continued use after such updates constitutes your acceptance of the revised terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the country where Surveris operates (currently the United States). Any disputes will be resolved in the courts of that jurisdiction.
